What is DACA?

On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of 2 years, subject to renewal. They are also eligible to request work authorization. Deferred action is an exercise of prosecutorial discretion to defer removal action against an individual for a certain period of time. Deferred action does not provide lawful status.

Who is eligible for DACA?

  • Have come to the U.S. before turning 16 – You must have entered the United States before your 16th birthday.
  • Be under age 31 as of June 15, 2012 – That means you were born on or after June 16, 1981, to satisfy that “under 31” requirement.
  • Continuous residence since June 15, 2007 – You must show that you have lived continuously in the U.S. from June 15, 2007, up to the time of filing.
  • Physical presence on June 15, 2012, and when filing – You need to prove you were physically present in the U.S. on June 15, 2012, and also at the time you apply.
  • No lawful status on June 15, 2012 – At that date, you should not have had lawful immigration status or valid parole in the U.S.
  • Educational or military requirement
    • You must either:
      • Be currently in school, or
      • Have graduated from high school or obtained a GED, or
      • Be honorably discharged from the U.S. armed forces or Coast Guard
  • Clean criminal record / not a public safety threat – You must not have been convicted of a felony, a significant misdemeanor, or three or more misdemeanors. You must also not pose a threat to national security or public safety.
