The holiday season is here—a time for celebration, family, and community. But it’s also a time when law enforcement increases patrols, checkpoints, and speed traps across Oklahoma. For immigrant communities, the risks are especially high.

A DUI (Driving Under the Influence) is not just a traffic offense. For immigrants—whether you have a green card, DACA, TPS, a work permit, or no status—a DUI can lead to arrest, ICE detention, and even deportation. Even one incident can have life-changing immigration consequences.

Understanding the 0.08% Alcohol Limit

In Oklahoma, the legal limit is 0.08% Blood Alcohol Concentration (BAC). This measures how much alcohol is in your bloodstream.

Most people are surprised by how little it takes to reach 0.08%.

For the average adult:

  • Women:5 to 2 standard drinks in an hour
  • Men: 2 to 3 standard drinks in an hour

One standard drink =

  • 12 oz beer, or
  • 5 oz glass of wine, or
  • 5 oz shot of liquor

Even a couple of drinks, especially on an empty stomach, can put you close to or over the legal limit.

And importantly, you can still be arrested below 0.08% if the officer believes your driving is impaired. During the holidays, officers are trained to look for even small signs of impairment.
